Legal Question in Immigration Law in India

hello sir my name is dr. tarun kapoor....i have recently got married with an american citizen girl in american court.i have a visitor visa,as i have reached india within a week after gettin marriage

if my wife issuppose to file my case as i m not stayin with her at this present moment?

if she dont file my case can i use my visitor visa ?

i will b very grateful if u will answer my questions

Hi, your wife has to petition for you so that you can return with permanent residency. Returning with your visitor's visa is not impossible but extremely difficult because you have to show your intent to return to India and usually being married to a U.S. citizen is an indication that you will remain here permanently. your wife can proceed with your immigration process in US and you keep visiting her on visitors visa till the visitors visa is not converted into dependent visa in US.
