complaint against lawyer

I filed a consumer complaint in August 2005 aginst a builder for cheating me.

Another petition was filed to stay the builder from selling the flat.

But for the past three years there was no hearing of my case in the court. Whenever I asked my lawyer about the case. he asked me to wait for few more days. Like that one year passed.

Then I started write letters. He started to reply. When I informed him that the disputed flat was occupied by the builder, he infgormed that the matter was discussed with judge. Then he written me that the judge ADVISED him either to file contempt case in the civil court or to file a police complaint.

He also informed me that in case of filing contempt case the case would further be delayed by 2 more years. I written to him that acceptance the time delay, as that matter will be make some problem to the builder. But he refused to file contempt case.

Then I written to him asking for copies of my case me to file police complaint against the builder. It is over 8 months, but he has not sent me the copies of my case. (I asked him to provide the copies of case filed in the court even in the initial days, he declined). All his action benefit only the opposition party not me.

You may approach the concerned court; file an application for "inspection" of records; obtain copies of entire records from the court; you may also demand a copy of the record from your lawyer; and if does not supply, you may change the lawyer;

You may also consider filing a complaint of "professional misconduct" against your lawyer before the State Bar Council.
