When can a person file a case of mental agony against someone?

Are conditions for mental agony laid down anywhere in Indian Law?

Suppose a person is mentally agonised after suffering a loss in the share market by following the advice given in the newspaper, can he claim damages for the mental agony suffered?

No he cannot. One is not obliged to follow the advice offered in News papers. no case of mental agony in such a situation is maintainable. If a person is unable to meet your debts/liabilities, he may file for insolvency to protect himself from the ire of his creditors.
