Legal Question in Personal Injury in India
I am a tenant for last 5 years in a society in Dwarka,New Delhi. In our Society there are two manual Lifts which malfunctions time and again.
Two years back ,my son's foot was caught in the lift and was operated twice to make it look normal.
I had no mediclaim and any other insurance to cover that and had paid for all the expense myself.
After quite some time I had come to know that the Lift are not certified and they did not pass the criteia to operate. Now I wsih to seek a legal advice that can I file a suit for the injury and pain caused to us for operating non-certified Lifts, after 2and half years gone.
How to proceed in this directions.

Period to claim damages is three years. you may file case for damages but please confirm if per bye laws of the society a member may rent out his flat.
you may file a case for the award of damages and compensation against the society and for this, you may also approach the consumer court.
