Legal Question in Real Estate Law in India

Dear Sir,

I don't explain my problem perfectly in english so I write in Hindi as english.

Sir, Mere Father ne hamara old makan A party ko sell kiya aur Banakhat ke rop me Rs. 2 lakh liye. Hamane Nottery ke dwara Legal Document karwaya aur usme makan lene wali A party ko 3 month me baki ka payment karne ka time period diya tha. Aur is banakhat me Itana hi likha hai ki "3 month me samane wali party ko baki ka payment karna hoga." iske siva aur kuch nahi likha. To ab 2 days ke baad samane wali party ke 3 month complete ho rahe hai... aur is darmiyan usane Rs 5 - 5 lakha ke 2 check bhi diye the lekin dono check return ho gaye... In 3 month me usane banakhat ke 2 lakh ke siva aur koi payment nahi kiya hai.

Aur abhi usane 2 din pahale ek notice bheji hai jisme likha hai ki "Hamne use light bill aur Makan ke Original Document nahi diye ya nahi bataye isliye usane baki ka payment abhi tak nahi kiya.. Hamane abhi tak koi bhi legal action nahi liya hai.

Hamare is makan ko lene ke liye ek B party bhi ready hai... aur wo B party hame turant payment karne ke liye bhi ready hai..

To abhi meri problem ye hai ki ye makan jab hamne sell ke liye rakha tha tabhi hamne ek makan aur puchase bhi kiya tha. Ab hamane jo makan purchase kiya hai use bhi payment karne ka time aa gaya he... aur hamare sell karne wale makan ke payment se hi hum apane purchase karne wale makan ka payment karne wale the... isliye abhi bahoot lambi legal fight karne ka hamare pas time nahi hai...

To kya ab hame A party ko -

1 month ki legal Notice deni hogi

ya

Check return ki FIR karni hogi

ya

phir hum ab banakhat ka time period complete hone par A party ko inform kare bina B party ko makan sell kar sakate hai ki nahi....

Pls. Let me know, what is the right & fast process of this problem
