Legal Question in Real Estate Law in India

Hi. I am from Karnataka, India. My father has a land property. He is a retired engineer and is 76 years old. He has lost the original of sale deed done on stamp paper (the one worth Rs 2,000), original of rectification deed and conversion order; since they are about 30years old.

But he has certified copy (the one with Rs. 10 legal stamp) of sale deed and rectification deed. The sale deed covers the sale done to him by the seller. He does not have a copy of sale done previously to the seller. When we approached DC office for a copy of conversion order we were told that the documents were destroyed and they gave us a certified copy saying so. He has tax paid receipt, EC for last 30 years, MUDA approval & certificate.

The contacts who sold the land or were involved in the process long back have been expired (due to natural causes). What my father and I want to know is based on the above proofs how much control he has on his land for purposes such as loan for building a house or selling the land. Could you please let us know ? If there is any other documentation we need to do please let us know.

Dear Sir / Madam,

As long as your father's name appears as the title holder of the land on the record of the District Registrar, he has full control over the land and he is free to either construct a house thereon or even sell it.
