Stamp Duty under Amnexty Scheme at mumbai

we have purchased our flat at Mumbai in 1970 for Rs 35000/- at that time our society has acted as Builder and given the order to construct the building to contacter for the saem we paid charges, hence there is no agreement is available, we ahve only share certificate issued by society in name of my father and mother and after my father expired it has been transfered to my mother name.

Please advise us as explain above still we have to go and pay the stamp duty under amnexty scheme for Mumbai, if yes then what are the procedure, since there is no agreement pappers are available only share certificate is avaialble

As we are not getting correct guidiance from any body.. Please give us your correct and honest gudiance. We are in real tention

(a) First you should ascertain the position about your title from the Society;

Have your mother's or father's name been registered in the records of Society as owner of the flat ?

(b) If yes, you need not to do anything.

If no, you ask the Scoiety to enter your name in the ownership records for your flats.

(c) If the Scoiety demands any payment of stamp duty, you will need to go and enquire from the office of 'local authorities' of your area about the amount of stamp duty.

In my opinion, since you are an old owner, having the flat since 1970, you will not need to pay any stamp duty at this stage.
