Legal Question in Real Estate Law in India

Subject: NON COMPLIANCE OF COMPLETION TIME BY BUILDER-INDIA BUILDERS, ST MARKS ROAD BENGALURU - PLATINUM CITY A BLOCK

Sir,

I have purchased a flat bearing No.A/4/20 at Platinum City from M/s.India Builders Corporation, Sheriff Centre, St Marks Road, Bengaluru 1 on 28th July 2011. Their office phone No.080-22278134, 080-22276167, GM Mr Purohit 9880009571). In the sale deed it was clearly mentioned that the flat would be completed by September 2011. However, inspite of my repeated requests, the builder did not complete the work and ultimately the flat was handed over to me in June 2012. Even though, the builder claims to have completed the flat, the entire A Block in Platinum City is still in complete. There is also quality issue in construction work resulting leakage, seapage, incompletion of painting works, polishing etc. The pending works are (i) Lifts, (ii) Parking (iii) Staircase access (iv) Lobby (v) Passage (vi) Terrace Swimming Pool etc. These pending works are creating lot of problems to around 50 occupants of the building. I have been sending mails and speaking to the representatives of the company including the senior officials of India Builders Corporation, but has not yielded any results. Unless the building is completed, we cannot get Occupancy Certificate and A Khata also.The builder has collected full amount from all the purchasers of the apartments, but delaying to complete the work on some pretext or the other. Even the Capsule lifts which are helpful to the residents is not getting ready for the last two years.The builder was claiming this A Block as "Special" but the result today is it is still "hopeless".

I cant afford to fight a legal case against the builder. I am writing this to you Sir, to kindly help me and other helpless residents to get justice and order faster completion of the work. Sir without your intervention i am afraid this builder may take few hundred years to complete the building.
