Legal Question in Business Law in Indiana

Non compete questions after merger

I started working at a small, privately held company 19 months ago. At the time of employment I signed a non compete clause. 1 Month into my employment it was acquired by a publicly traded company. I have since lost my non compete clause agreement. I have a job offer from a company over 300 miles away in a different state but who is a direct competitor. My question, is the non compete clause binding since it involves a job in a different state, signed before the merger and over 18 months ago?

Re: Non compete questions after merger

There is not enough information provided to allow for an answer. The merger documents and your non-compete agreement would have to be reviewed.
