Legal Question in Credit and Debt Law in Indiana

Hospitals Have to Accept

My husband has a disease that requires that he have out-patient care every eight weeks. Each time he gets this care, we owe over $1,000 after insurance pays. As you can imagine, this is burdensome.

My question is this: I have heard that, as long as you make monthly payments on a medical bill and do not miss any payments, the hospital/doctor cannot send your account to a collections company. My mom told me this, but she lives in Georgia and I recently moved to Indiana. Is this also true in Indiana?

Re: Hospitals Have to Accept

Not true unless there is a signed agreement between the parties to that effect.

Lots of folk get into trouble proceeding on that assumption and then get shocked when the creditor sues them.

Bottom line: Absent a written agreement to the contrary, if you don't pay the full amount when due, the hospital can take you to court, even if you're making payments. Suggest you call them and arrange a payment schedule.
