small claims interest

I am being sued for child care charges and the provider is charging me monthly interest. She is charging between 12-20 dollars per month. There is no judgement entered as of yet and our contract does not provide for interest. Can she charge this?

If you are getting sued under the new contract, then husband is not liable.

Indiana law allows for prejudgment interest. If I recall correctly, the statute sets judgment interest at 8% interest.
