Legal Question in Criminal Law in Indiana

My brother was arrested on Meth charges over a month ago. He was released four days later with papers that said he could be re-arrested. Is there a certain amount of time that they have to issue a warrant for his arrest? From my understanding he was released because he was not officially charged in a timely manner. He was in jail 4 days and never formally charged and never saw the judge. A couple of the people arrested with him have already been rearrested. It has been about 45 days since he was initially arrested.

He should speak with a lawyer - and ONLY a lawyer about any charges he may have coming his way or pending. A lawyer can also help determine if there is an arrest warrant out and maintain contact with the investigating agency so he can be surrendered at a convenient time and place instead of being arrested outright anywhere and anytime when it is least expected.
