Legal Question in Criminal Law in Indiana

probation violation

recently my son was arrested for a probation violation, as I am unable to provide proper legal counsel, I wondered if you could suggest resourses that are available to me for his defense. I understand also that a plea agreement may not be appealled, is this violation a means to modify the original sentence? What recourse do I have as a defense against a violation by urine screen? Have their been successful defenses used? Are their any legal precedents I should know? Is their a website where I can review previous cases by county in Indiana, I believe these are all public records, correct?

If your son cannnot afford an attorney, he should ask the court to appoint a public defender. I would not suggest you undertake his defense as each case is different even in a probation violation matter.

If found to have violated probation, there may be a number of possible results. While he could receive the suspended time given on the underlying sentence, it does not necessarily mean that he will. He could recive some or nothing at all.It will in large part depend on the probation officer. The judge hearing this matter may also have a certain view different from other judges in other counties. Therefore, a result in one place does not mean the same will be had for your son.
