Last Names of babies at child birth

my boyfriend is in jail. i was wondering if there was some sort of legal paper he could sign before the baby was born so the baby could still be givin his last name at birth?

No. If he is not present at the time of birth to execute the paternity affidavit, his name will not appear on the birth certificate as the father. You, as the mother, have the right to give the child any name you desire, so the child could at least have his last name if you want that. You will have to wait until after the birth to have paternity established in the court - or get married before the birth in order for his name to be on the birth certificate.
