Legal Question in Family Law in Indiana

I'm trying to have a paternity test for my son. I'm currently on medicaid coverage, that covered the pregnancy and birth, and will cover my son for a year afterward. My question is, if I find out the father of my son, will medicaid come after him for reimbursement or any kind? Also, if he is willing to sign over his rights, i've heard that he may still have to pay child support...if I don't want or need the child support, will he still be court ordered to pay it? Thank you! Erin

Medicaid can come after him for reimbursement. He can't sign over his rights although he can consent to an adoption. He will be required to pay the support. It is not yours, exactly. Rather, it is your son's child support, you are the financial custodian for those funds. As a custodian you owe your son a fiduciary duty from a financial standpoint and cannot waive child support.
