Legal Question in Medical Leave in Indiana

Small company exceptions to the Family Leave Act

does the size of the company have any affect on whether the company has to abide by the Family Leave Act? Can a company dismiss or not keep an employee's job for leaving work for pregnacy?

Re: Small company exceptions to the Family Leave Act

The FMLA only covers employers with 50 or more employees on the payroll for 20 work weeks during the current or preceding calendar year. Also 50 or more employees must work within 75 miles of your worksite for you to be covered.

A company not covered by the FMLA is not required to keep your job if you leave because of pregnancy unless they have a policy of allowing leaves of abscence for non-pregnancy disabilities.
