Legal Question in Civil Litigation in Indiana

I have a law suit going in superior court. Our subdivsion restrictions state a homeowner can not be in violation of any zoning laws. We have a honeowner that is violating a zoning law. Can the superior court judge issue a injunction against this homeowner or does the area planning commission have to rule first that the homeowner is indeed in violation
