Legal Question in Intellectual Property in Indiana

Copyright infringement

My wife ordered a movie from a person on eBay and when The movie arrived it was an obvious reproduction. I wrote to the seller and said this was illegal unless he had purchased the rights and to please provide me with the proof of such or with the instructions on returning the DVD for a refund. He wrote back that the Berne Convention of 1995 gave him the right to copy and distribute any movie out of print for two years. Everything I could find said 50, 70 and/ or 90 years. I just want to get to the factual bottom line. Is this seller telling me the truth?

The seller is not correct. Demand your money back, and report him to ebay.
