Final Paycheck Deduction

Left employer in Feb.'05 for better job. Got final check (for 2 wks vacation) but stop pymt was put on check. New check issued Mar. 4 but $1200 deducted - exboss said ''poor workmanship'' but he also said I should have given him 2 wks notice not 2 days. Have both checks in my possession. Need advice - what are my legal rights.

Generally, you are entitled to the entirety of the vacation pay. Also, generally, an employer may not deduct money from your paycheck without your express permission. In addition to the monies your former employer owes, you may also be entitled to recover liquidated damages and any attorney fees you incur. If you are a salaried employee, you need to hurry to enforce your rights before the Indiana Legislature passes an amendment to the law which currently protects your wages from non-payment and unauthorized deductions. That law, the Indiana Wage Claims Statute, allows you to recover unpaid wages, a 10% a day penalty up to 200% of the unpaid wages, and attorney fees.
