Legal Question in Employment Law in Indiana

non compete contracts

i have been a hairdesigner for twenty years. i have been at the current salon for a year. it was a brand new salon and i brought my own clientele when we opened.the salon is now wanting us to sign the aggreement to non compete and i was wondering if it is even legal for them to do this after we have been here a year.and along with the agreement they are wanting to charge us a surcharge on all services and take away our commission on first client of the day if we are not there before opening at least fifteen minutes. there has been a change of owners to salon and it seems that they are not playing fair to the ones who have been there since the opening. PLEASE HELP!!!

Re: non compete contracts

It is not illegal to request current employees -- even of long standing -- to sign a non-compete. There are, however, a number of ways to challenge a non-compete and I would be happy to talk to you about them. As to changes in your compensation plan, it depends on your status as an employee vs. an independent contractor and a number of other factors.
