Non-Compete void due to illegal activity

I have a non-compete for 5 years and 100 miles from where my company does business. The problem is that I love what I do, but my employer was arrested for serious crime, and in the past he had been convicted and served time for the same act. So I quit due to finding this out. It is a great business and I don't want it to fall apart but he refuses to sell it and with the non-compete I can't start my own. I have talked to a Lawyer and He said that the courts here don't take non-compete cases seriously and just figure you signed it so you agreed to it. Due to the circumstances I wanted another opinion on what more can I do.
