settelment

My husband was receiving a settelment. He was already paid half of it. The attorney had signed off on the remainder and had sent the paperwork for the check to be processed when my husband had a massive heart attack and passed away. Am I entitled to receive that money for living expences for myself and our children?

If you husband had a will, the will would determine how this money is to be distributed, subject to your rights as a spouse. If he did not have a will, the Intestate Statute determnes how this money is to be distributed. Depending on the amount of the settlement, you may have to open an estate. You need to consult a probate attorney to discuss this. However, before doing so, talk to the personal injury attorney, perhaps he will take care of this as a courtesy, or suggest other options.
