Legal Question in Personal Injury in Iowa

Car/truck accident personal injury child

My daughter age 16yrs was in a car/truck accident on Dec. 28,2001. Her car was totaled and she received injuries. I got a lawyer, but he does not seem to help much. Does not explain things and does not write down what I say. He said I hadn't told him things about the car damage when I had. It was not my daughters fault. She was rear-ended. The other insurance is in Texas and is difficult to get ahold of. The car is settled and my lawyer said he would not charge for this but I did not get it in writing. Can I change to another lawyer for the personal injury part and not be charged or at this point do I stay with a lawyer I do not trust anymore and deal with whatever he does?

You have the right to change lawyers just like you might change doctors or dentists. You should make sure that your bill is paid for any expenses the attorney has incurred and depending on your written contract with him/her (if there is one) you may be obligated to pay an hourly fee for the work done to date. You should obtain your whole file and a letter from him stating he has withdrawn and has no claim against any future settlement or judgment. Before hiring a new attorney you should make several inquiries or get a referral from someone you trust.
