Legal Question in Family Law in Kansas

Joint custody and visitation

I have 2 daughters with my ex husband. He has physical custody, we have joint custody. He won't let me see or talk to them because I won't get back together with him. He recently took me to court for child support after 3 1/2 years. I now have to pay $50 per month and my only income is public assistance that I receive for 2 other children I have. Not with him. He has been allowing my mother to see the girls but now since she inquired recently about bringing them over to my house to see their brother and sister, she is not allowed to see or talk to them either. My daughters were crying on the phone today to my mother because they want to see me and he flat out said no and told them they aren't seeing her anymore either. Then he blamed my mother for the girls getting upset. What can I do? What are my rights? I can't afford a lawyer and legal aid in Kansas won't take my case without me paying $1,000 upfront. I don't have that money. He is now saying he is getting a restraining order and I'm not even harrassing him. I am just trying to see my children. I am paying the child support so that isn't the issue. I don't know what to do.

Re: Joint custody and visitation

There is a procedure where a pro-se litigant can file an expedited hearing request pursuant to K.S.A. 23-701 et. seq. so long as you have been granted visitation rights in your divorce. The clerk should have a form for you to fill out and you will be able to go in front of a judge and tell him/her what is happening and the judge should enforce your visitation rights, unless there is a compelling reason why visitation with your children are not in their best interest.
