Out of State half-brother's custody rights?

I have 2 half brother's living in Kansas with their biological mother. My father, (and theirs) passed away in September. She is choosing to live a damaging lifestyle that may include some illegal actvity and I believe there will come a time I may need to step in and take my brother's and gain custody to ensure they live a normal, happy, productive life and are cared for properly. Do I have any rights whatsoever?

Should the Dept of SRS find that the children are not being given proper care by mom, it's possbile the court would place the boys in SRS custody w/out of home placement. It is at that time, SRS and the Court must consider other family members for residential placement of the children. Anyone can file a Petition if there is a concern for welfare of children.
