changing childs last name

My child is eleven years old her father has not been a part of her life, the only support I recieve is his taxes once a year. I have married and my child wants to change her name to mine and my husbands last name. Can I do this, without his consent considering I do not know where he lives and or how to contact him. I also have full custody and he has never had visitation established.

You can make the attempt and a judge may allow the name change, but it is unlikely that you will succeed without the father's permission.

You could initiate a petition to terminate the parental rights of the father and you would likely have more success under the facts that you gave. Then, the step-father could adopt your daughter if you all wished or you could then authorize the name change.
