Claiming tax deduction on child

I (dad) have custody of my daughter. Ex and I have an Agreed Order that my daughters mom can have the tax deduction each year. Ex is has not paid any CS or her portion of medicals. Can I claim the tax deduction since she is not providing her portion of support? Ex lives in Ky, I live in Ohio. Case was heard in Kenton County, KY.

Your ex really should not claim the deduction if she paid no support during 2007. That said, for you to claim the deduction without a change in the court orders means you run the same risk that she does of being held in contempt of court.
