divorce

my divorce was final last year. we agreed on the division of property and debts. since that time my ex had filed and completed bankruptcy and the debtors are coming for me. what is my recourse? Help!!!

I practice both family law and bankruptcy so I will be giving you two possible answers. In the agreement for division of debts and property, there should have been a bankruptcy clause or at least an indemnity clause. This would allow you to go forward back in the court where your divorce occurred to force your husband to take care of what was allocated to him as a domestic support obligation.

Another alternative might be to file bankruptcy yourself.

This place where family law intersects with bankruptcy law can be very tricky and a lawyer would have to look at the documents involved and the whole situation to give you the best course of action to take.
