Careless/Reckles Driving Issue

From what I've read, the terms careless and reckless driving are used interchangeably in Kentucky.

My question, I'm trying to get a conviction/arrest expunged that occurred in 97 but have a careless/reckless driving conviction which occurred in 99. I realize that one must have a ''clean'' record for 5 years before they can file a motion to expunge, do traffic violations count? Also is careless/reckless driving a misdemeanor or traffic violation? Someone here said it was a violation but my ex-counsel said it was a misdemeanor.

Originally it was a DUI arrest - I blew under the legal limit but the state trooper still took me to jail. In court it was dropped to ''driving contrary to the law'' and the court charged with careless/reckless driving, saying they had to charge me with something.

I really need a new lawyer.

violations count toward expungement. the court has discretion to grant an expungement in many cases regardless of the guidelines set forth by law which only set forth when a court must grant an expungement, such as when there have been no prior or subsequent offenses 5 years since the convision/end of sentence, or when it may not, such as when there has been a sexual offense.
