Community Property

The divorce is final. No property settlement yet. Can the ex-spouse that has remarried make the one living in the residence move? The property is on leased land that is leased by the one living in the residence.

The divorce should NOT be final without having dealt with the property fully and completely.

Divorce is about separation, leaving strings hanging is prolonging the marriage.

If the judgment didn't deal with property, it probably needs to be re-opened and have the judge make a ruling with deadlines and penalties for failure to comply.

You need to consult a local divorce attorney and get this sorted out.
