dwi and careless operation
Is it legal for an officer to give me a
dwi and careless oper. when they
never pulled me over? My car was
stuck in some mud, it was shut off,
noone in it or any keys in the
ignition. Me and some friends were
walking away when the police
showed up?

The real question is "are there defenses to this DWI charge?" The answer to that question is yes. You need a real defense lawyer, not just someone who will take your money & hold your hand.

Yes, it is legal for the police to write you a ticket if they have probable cause you committed a crime. Whether you are guilty is a much different matter from probable cause.
