i was recently charged with dwi and im wandering what artical 894 actually means does it mean it goes off your record for a year and within that year if you get another dwi it doubles but if you dont its odd your record for good??

It means that after you do your probation period and do not get into any trouble, you must Petition the Court to dismiss the charge. You have to pay extra and DPS must write a letter etc....(all can be found under 894 of the Code of Criminal Procedure) For all purposes except a future DWI the case is dismissed as if you were found NOT GUILTY. Should you get another DWI after the dismissal in the next 10 years, the first can be counted so that the 2nd one is a true 2nd offense and not only can the punishment be increased, but you cannot ask for another 894 plea.
