Child Custody

My fiance, who presently gets child support, has recently been getting harassing phone calls from her daughter's biological father. The child is only 5 and has not seen the man for 4 + years by his choice. We fear that his barging back into her life will only confuse the child. Is there anything that we can do to prevent this from happening? He presently does not have any custody rights whatsoever.

I know you don't like it, but the bio dad still has some rights. You should consult with a good family law attorney in your area and discuss the options.

If the biological father voluntarily has not visited this child in over 6 months his parental rights can be terminated if there is another person who will accept the responsibility of fatherhood.

In other words, you could marry this woman and adopt her child.

Marry the mother and adopt her child. Dad's incentive is that child support will stop.

PS....his consent is not necessary in an intrafamily adoption if you can show he has not had contact with his child "without just cause."
