Legal Question in Family Law in Louisiana

What does contempt mean?

my wife asked a question see COMTEMPT of COURT.. i went to pick up my child yesterday and was told by police that they could not enforce custody orders. They say ''Police do not like to be called in to a JUDGES chambers for interfering with custody''. So, i have scheduled every other weekend visitation and i will try again this weekend and every weekend thereafter until i can see my child. What consequences does she pay for contempt and for her not allowing me to see my child with court ordered rights? I know that a police officer can take down a case number when see doesnt allow me to see my child but when we go to court what happens? I also know she is preganant and expecting next week. She is on doctor ordered bed rest and this is a high risk pregnancy, when she is in the hospital and not able to care for my child can i get her?

Re: What does contempt mean?

Dear LawGuru Friend,

Contempt means that she has intentionally violated the court's order, the court's judgment. She can be fined and/or jailed for that. If she denies you the visitation privileges that the court has granted you already, then you need to take her to court for relief. Relief may be having her held in contempt and fined and/or jailed, having the custory order changed to specifically spell out the visitation rights you have, or obtaining joint custody with your being the domiciliary partent (That is, the child lives with you and goes to school, and she has visitaiton privileges.) There is more to it all than this, but his is something to think about.

Best of luck!

Sincerely,
