can anyone be dissmissed after FMLA is exhausted and still under doctors care

You must return to work after you have exhausted your FMLA leave. That is different than exhausting your paid vacation and leave from work, though. FMLA requires certain absence periods for certain situations, but does not require the company to pay you after you have exhausted your vacation pay, sick pay, etc. The company must keep your job for you, though. However, if you are still unable to return to work after having exhausted FMLA, you need to go on disability. Some companies offer short term and long term disability. You may also qualify for Social Security disability. There are a number of attorneys on this site who handle Social Security disability claims, although I am not one of them.
