Legal Question in Medical Malpractice in Louisiana

My son broke his arm. We took him to the hospital and were advised that it was broken after x-rays were taken. After 2 postponements by the doctor that casted my 6 year old son's broken arm we found that the arm was not set properly. My wife and I do not have medical insurance. My question is this, is the doctor liable for having my son's arm corrected?

Of the doctor caused harm to your child due to negligence, mistake or incompetence, you may have a medical malpractice action for him. You must file it within one year from the date of the occurrence. The first step is a medical review panel, where a panel reviews the medical files and determines whether their was negligence.
