Legal Question in Personal Injury in Louisiana

Automobile accident

My daughter, age 16, went off the road due to diesel fuel being on stretch of highway. I am not sure, but suspect that the damage to the car would require it to be ''totaled''. Police indicated that the drilling company is at fault. After obtaining police report what should be my next step? I have notified my insurance company of details. They indicated that they would contact the drilling companie's insurance if we would bring them the police report. Friend in car with my daughter received a nasty bump on the head. Thank You.

Re: Automobile accident

Your next step would be to have your daughter treated for the head injury and whatever other soft tissue injuries she might have incurred. She should not stop treating until her pain and or problems have stopped. There are several additional steps you can take to increase your chances of recovery, and increase your potential overall recovery, in a personal injury case, even before you meet with an attorney. Such steps include: (1) writing down as much as you can about the accident or injury itself, your injuries and any other losses (such as wages) you've suffered as a result of the accident (2) making notes of conversations that you have with people involved in the accident or the injury claim (3) preserving evidence of who caused the accident and what damage was done by collecting physical evidence and taking photographs (4) locating people who witnessed the accident and who might be able to help you prove your case (5) notifying anyone you think might be responsible for your injuries of your intention to file a claim for your injuries.

You appear to be trying to go this alone I would contact an attorney to negotiate the settlement and ensure you get everything you are entitled to. Why should you hire an attorney to assist you in resolving your daughters personal injury claim? Simple. Higher net recovery to her, an experienced guide on your side, and relief from worry. An insurance industry research institution studied personal injury claims processed by the injured person alone, verses personal injury claims handled by attorneys. They determined that those represented by attorneys had a higher net recovery to themselves (more money in their pocket after attorney's fees and costs) than those without attorneys.
