Legal Question in Personal Injury in Louisiana

Battery

I was assaulted by an ex-boyfriend, and did not notify the police at the time (one week ago). Now, I am in severe pain (back pain). Is it too late to file charges against him? How can I get him to pay for my doctor bills?

Re: Battery

It is not too late to file a police report; contact law enforcement at once. Contact the city attorney or district attorney's office [whichever is involved] and inquire as to whether charges are being filed against your ex.

Regarding the medical bills, you can file suit against your ex-boyfriend for personal injury and medical bills; please note that suit must be filed within one year of the date of assault. Alternatively, if he is prosecuted in criminal court, you may be reimbursed for your medicals as part of the plea agreement. However, be aware of your one year time limit in civil court; the criminal proceedings may not be completed by then and you may need to file suit to interrupt prescription.
