Legal Question in Personal Injury in Louisiana

Pain and suffering

My wife went into premature labor and had my child that evening(one month early) due to a car accident in a parking lot. My wife and child stayed in the hospital for four days. We had to bring my baby to the doctors office the following week three times due to breathing problems.

1. How much pain and suffering shoud we ask for?

2. Should the other insurance company pay all of our out of pocket medical expenses.

I agree with Nick. Pain and suffering is personal to each situation and highly subjective. Each instance of pain and suffering must be evaluated on an individual basis.

I don't know since I don't know what damage you, your wife, and/or the child suffered as a result of the accident.....any expenses you incurred AS A RESULT OF THE ACCIDENT, AND THE ACCIDENT WAS SOMEONE ELSE'S FAULT, you have a right to recover that expense.
