after a lawyer has been withdrawn from a case are they allowed to take 37% of the settlement or just the fees?

An attorney is entitled to collect for work he performed on a case prior to his withdrawal.

If you have a problem with the amount of the attorney's fee demand, you should talk to the attorney and see if you can come to some mutually agreeable arrangement. If there is a legitimate reason for lowering the fee (e.g., substantial work was done on the case after the attorney withdrew), the attorney would certainly consider that.

If suit has been filed, you can have the Court decide how much the attorney is entitled to. The Bar Association also has a committee on fee disputes, but those are extreme measures that you probably will not have to entertain if you simply call the attorney and work it out.
