Undivided Property

My husband and I recently bought out family members on a piece of property that is 4.25 acres, one family member was entititled to 1/9 of 4.25 acres. We have tried to come to an agreement on where that will be but he refuses to negotiate and we want to start building a home. Can we file for a Partition in Kind or do we have to hire an attorney?

You can file for partition in kind or by licitation. You are not required to own the property with someone else, so the court can order the property sold at sheriff's sale. You then buy the property at the sale. The relative would get 1/9th of the net after expenses are paid.
