divorce/ custody minor child

my spouse and I have nothing owned and he has left state, does not pay support and has not seen child in months. we agree on divorce. so can I still file no contest and get custody of my child? And how do I do that if he's not inthe state?

You can still file for a divorce but he has to accept service of the complaint. He can do that by simply acknowledging and signing an acceptance of service.

You'll need to know his income in order to do a child support order that the court will require if you get a divorce.
