Legal Question in Medical Malpractice in Maine

methadone

my father went to the methadone clinic every morning for his daily dose to care for the pain in his foot. He passed away 7 months ago, and i just heard from the autopsy results that it was because of a methadone overdose. My father was in the hospital about a month before that with tremors and the doctors there sent him home. I am not sure if this is malpractice because the doctors at the clinic overdosed my father or if it is just considered a mistake. Please let me know what rights I have and what avenues to persue. thank you

Re: methadone

Hi, Let me start by expressing my sincere condolences....it must be very difficult for you. I have to admit that your inquiry leaves me with more questions than answers. Medical malpractice is an extremely complicated area of the law. It is impossible for me or any other attorney to answer your question without knowing a lot more information, as well as seeking the appropriate medical expert opinion after a thorough review of the medical records. I would certainly like to help you explore the possibility that there may have been malpractice here. You may email me with your number and a good time to call you. There is a 3 year limit on your ability to bring an action against the medical providers, and the date of the injury is the starting point for determining the deadline for filing suit, or you may forever be barred from doing so. I look forward to hearing back from you. David Marchese, Esq.
