Legal Question in Credit and Debt Law in Maryland

Wage garnishment

Dear Sirs. I currently am having wage garnishments for child support and for a debt which occured in Maryland 8 yrs ago.I purchased some furniture via a credit card from Montgomery wards 8 yrs ago but then lost my job and marriage and moved to Wy. Recently they have won a suit to garnish my wages for the debt. Now when I get my paycheck I dont have enough money left to pay my mortgage and utilities and am at risk of losing everything again. Can I stop this debt garnishment somehow? I cannot afford to pay the debt and continue working.I am at the end of my rope.

Re: Wage garnishment

Wage garnishment orders are state specific. Your question involves two different types of debt. The child support order will remain an order executable by Maryland Courts. Your state may be permit suspension of your driver's license for non-payment. If your wages cannot sustain the child support order, we should discuss a modification.

The department store debt is an entirely different matter. Montgomery Wards has entered into receivership for a bankrupcy filing and what you purchased and how you purchased will determine where you stand with respect to a garishment order.

If you feel that your credit situation has gotten the best of you, contact a free credit counseling service. If you feel that you cannot withstand garnishment orders, contact an attorney. A free credit counseling service will not assist you with negotiating a re-structuring of your debt.
