Legal Question in Family Law in Maryland

Custody question

I am set to go to a Masters Hearing in regards to the custody of my daughter. The Mom is seeking sole custody of which I am not contesting. I also stated that I did not want specific visitation. I didnt go to the scheduling hearing and am not planning on going to the masters hearing either. She did not ask for child support in the custody complaint (cuz we already have a verbal agreement and I am not in arrears). However, at this masters hearing can the judge make a ruling about support even though this is a custody case?

Re: Custody question

If the mom didn't petition for support then it can't be imposed at this hearing, since you aren't on notice. However, the master could raise the subject and encourage the mom to file so there is an order in place in case you stop voluntarily paying. You would then be served with a new peitition.

Re: Custody question

Depending on how the prayer for relief was worded the master may find away to address the child support issues. If the mother of your child tells the court it is already resolve the Master may not even address it. The Master may indicate to her as well that she might want to look at child support in the future and make sure it is according to the guidelines. The best course would be to have a written agreement put on the record to protect you from having to address this issue in the near future.
