Legal Question in Family Law in Maryland

custody and transfer of jurisdiction

I have joint legal and physical custody of my child. My child is residing with her godmom in charles cnty, dad-pg cnty,mom-st.mary's cnty. The dad doesn't agree with me that the child should live with me due to her being 6yrs old. I want to make the change anyway since the child is not living with either parent, and i am not able to have her live with me. how do i get the jurisdiction change and also i want sole custody, at least physical.

You should file a petition to modify custody in the county where the original order granting joint custody was entered. Unless you signed something granting temporary custody to the godmom, you could insist on taking her back now, as your rights are superior to the godmom. If she refuses, take your custody order to the sheriff or police dept. for assistance.
