Legal Question in Family Law in Maryland

the father of my child is Egyptian and lives in Egypt. I have lived with the child for more that a year in MD, we are both US citizens. he filed a custody case in MD and requested the child to go back to Egypt. I have custody from the Egyptian courts. Can the MD court actually order the child to go back? What can i do to prevent that?

Family courts are generally reluctant to disturb the life pattern a child has built, though this varies by age. The older a child, the more settled a child's lifestyle can get -- school, friends, neighbors and all -- and a court would be loathe to disrupt this. For infants, it would be a little different. Also, if there is an existing order in place from the Egyptian court, a Maryland court would likely give effect to this and the father would have to show some significant change in circumstances to have the existing order altered. That is, if the matter has already been decided there would have to be some big change that has occurred since then to revisit the issue. If there is a pending case in Maryland the best thing you can do is hire a family law attorney to defend you.
