Legal Question in Family Law in Maryland

Is home bought pre-marriage marital property

I own a home that was purchased and paid for in full before I got married. I have now been married for five years and am thinking about filing for a divorce. Does my spouse have any interest in the home simply because she has been with me in the home for the past five years even though I owned the home outright before we got married?

Re: Is home bought pre-marriage marital property

Under MD law, property owned by one of the spouses before the marriage remains the property of that spouse. Now, if during the marriage you had to make mortgage payments and did so from your income, which is considered marital property, your wife would have an interest in the property, albeit not as great as yours. But as I understood your question, you owned the property free and clear before getting married.
