Question Re: Garnishment
Hello,
I have a question regarding garnishment. I have a judgment against my husband and me for $1092.00. The garnishment began two pay periods ago (on me only) and so far the law office has rec’d $482.00. Today, my husband found out that his pay is also going to be garnished. Can they garnish both of our pays if we’re married? And how do we prevent them from taking too much? Should we object to my husband’s garnishment or try to recoup the overage after it’s all over?

They can garnish both paychecks since you are both named in the judgment. The amount is limited to 25% of take home pay. Since they are garnishing simultaneously, there's a danger of overlap since one employer won't know how much has been taken out from the other's paycheck. I suggest you contact the law firm doing the collecting and find out how they're going to handle this.
