Legal Question in Intellectual Property in Maryland

I launched a website that gave a negative review (similar to review sites like amazon.com, etc) of the poor customer service of a company. (they hung up on me when I tried to control the conversation enough to get the answers to my questions regarding what brand name parts go into making their system) Now I have received a cease and desist letter saying I must take my site down or be sued. They claim that my site cannot have the name of their company in it, that this constitutes copyright infringement and said I commited tort by saying on the site that in my opinion since they refuse to reveal what brand name parts they use they must be using inferior parts in my opinion. To aggrivate matters they sent copies of this c&d to my bosses at work because I used my work email acct during my original conversations with them. Do they have a case, and if not do I have a countercase since they are clearly trying to get me in trouble at my work jeopardizing my income and or promotion eligibilty. Thank you.

It sounds to me like you got a C&D letter from the other co's in-house counsel. They are lawyers, and they have nothing better to do with their time than sue you. I'm not entirely sure whether you are talking about patent or trademark infringement.

I advise you to get a lawyer on your side. If this is a multi-state issue, or in federal court, I can help. I'm a multi-state litigator defending corporations in patent and trademark infringement cases.
